Legal information

Incorporated association

Our full legal name is The Gas Works Motorsport Incorporated. We were registered with NSW Fair Trading on 21 August 2013, registration number INC1301041.

Constitution

Our constitution is based on the model rules, with some changes. It was last updated by a vote of members at a Special General Meeting on 29 July 2017.

Not for profit

Under section 41 of our constitution the association is a non-profit entity. Subject to the Act and the Regulation, it must apply its funds and assets solely to the objects of the association, and must not conduct its affairs to provide pecuniary gain to any member. Section 5 of the Act defines "pecuniary gain" for this clause.

Code of conduct

Members must not

  • Refuse or neglect to comply with the club constitution
  • Wilfully act against the interests of the club
  • Behave contrary to this code of conduct
  • Act in a disrespectful, anti-social, abusive or undesirable way towards anyone
  • Do anything that may harm the reputation of the club or its members
  • Drive an unregistered or uninsured vehicle on club runs (off-road activities excluded)
  • Take part in a club activity under the influence of alcohol or drugs
  • Challenge the decisions of judges at car shows and motorsport events
  • Disobey safety instructions from a committee member
  • Discuss club issues with people outside the club without the committee's approval

Members must

  • Treat other people as they want to be treated
  • Be familiar with this code of conduct
  • Obey the road rules, including those relating to cyclists
  • Take responsibility for their own actions. The club does not accept responsibility for the negligence or actions of any person.
  • Make sure vehicles on club runs are registered and roadworthy. At least third-party property insurance is highly recommended.
  • Raise complaints or suggestions with a committee member, so the management committee can address them
  • Tell the membership secretary about any change to their contact details

Penalties can include a reprimand, exclusion from runs, suspension or expulsion from the club.

Privacy

When you contact us, apply for membership or submit a listing, we use your details only to respond to you and run the club. Membership details are shared with the executive committee only. Card payments are processed by Stripe; we never see or store your card number.
